La donación y el trasplante de órganos representan avances médicos cruciales, pero plantean importantes desafíos jurídicos y bioéticos. Este artículo examina la interacción entre el derecho y la bioética en la regulación de estas prácticas, abordando el problema de cómo garantizar un acceso justo y ético a los órganos, respetando la autonomía y dignidad humana. El objetivo es analizar los marcos legales y los principios bioéticos que subyacen a la donación y el trasplante, destacando su impacto en la práctica médica (...) y en la sociedad. Se utilizó una metodología basada en revisión bibliográfica, centrada en textos normativos, doctrinas bioéticas y casos relevantes. Los resultados evidencian la necesidad de fortalecer los marcos legales para equilibrar la equidad, el altruismo y la protección de los derechos individuales. Concluimos que un enfoque integral y multidisciplinario es esencial para abordar los desafíos actuales y futuros en esta área compleja y sensible. (shrink)

La vulneración de derechos en la atención sanitaria en Latinoamérica representa una problemática creciente que afecta la calidad de los servicios y la equidad en la salud. Este estudio tiene como objetivo analizar las principales causas y consecuencias de la violación de derechos en los sistemas de salud de la región, enfocándose en los derechos humanos, el acceso a la atención médica, la discriminación y la corrupción. Se realizó una revisión bibliográfica que incluye legislación, artículos que abordan la temática y (...) sentencias sobre la vulneración del derecho a la atención sanitaria. Los resultados indican que las vulneraciones más frecuentes incluyen la falta de acceso a servicios adecuados, el trato desigual hacia poblaciones vulnerables y la carencia de recursos. Se concluye que es urgente implementar reformas estructurales en los sistemas de salud de Latinoamérica para garantizar la protección efectiva de los derechos humanos y mejorar la calidad de la atención sanitaria. La memética es una disciplina joven que se inscribe en el campo de las teorías de la evolución cultural y que busca extrapolar hipótesis darwinianas de selección natural al campo de las ideas, proponiendo la existencia de replicadores culturales llamados memes. En el presente artículo se hace una revisión histórica de dicha disciplina, se examina la contribución que puede ofrecer a las teorías del cambio científico de Thomas Kuhn, Imre Lakatos y Edgar Morin y se hace una evaluación de la (...) memética desde una perspectiva epistemológica basada en categorías ofrecidas por Karl Popper, Mario Bunge e Imre Lakatos, presentándola de esta manera, en un proceso recursivo, como elemento explicativo e interpretativo a la vez que como objeto de estudio y análisis. -/- 'Science in light of memes. Memes in light of science.' -/- Memetics is a young discipline that is inserted in the field of theories of cultural evolution and seeks to extrapolate Darwinian hypotheses of natural selection to the field of ideas by proposing the existence of cultural replicators called memes. In this article, we present a historical overview of the discipline, examining the contribution it can offer to theories of scientific change by Thomas Kuhn, Imre Lakatos, and Edgar Morin. Lastly, we provide an assessment of memetics from an epistemological perspective based on categories suggested by Karl Popper, Mario Bunge and Imre Lakatos, thereby presenting that discipline in a recursive process as an explanatory and interpretative element, while at the same time as an object of study and analysis. The main objective of this article is to provide a critique of the pandemic strategy suggested by the World Health Organization (WHO) and implemented by various countries from March 2020 onwards in the wake of the coronavirus outbreak in Wuhan, China. Based on the theories of Michel Foucault, this critique aims to show that, in the first instance, the pandemic may be understood in terms of the art of governing human beings at the point of interaction between politics and medicine; (...) secondly, in Foucauldian terminology, such interaction may be referred to as ‘noso-politics’, that is, a mechanism used to control the body of the population via authoritarian measures exercised in the name of the health of the population; thirdly, such a mechanism exercises its power by invoking a mechanistic truth about the SARS-CoV-2 virus which may be countered by an argument that takes a historical perspective on the virus; fourthly, the pandemic strategy may be opposed by a syndemic approach that takes into account interactions between emerging diseases such as COVID-19 and non-communicable illnesses, as well as the biological and socio-economic conditions that the well-being of the population depends on. In short, by providing a critique of the politics of truth about the pandemic, the virus, and health measures, the article aims to encourage a critical attitude that will challenge both the authorities and the truth they invoke to prevent the pandemic strategy being used as a mechanism for governing, given the predictions of the recurrent emergence of new viruses. There is an ongoing debate about the meaning of lexical words, i.e., words that contribute with content to the meaning of sentences. This debate has coincided with a renewal in the study of polysemy, which has taken place in the psycholinguistics camp mainly. There is already a fruitful interbreeding between two lines of research: the theoretical study of lexical word meaning, on the one hand, and the models of polysemy psycholinguists present, on the other. In this paper I aim at (...) deepening on this ongoing interbreeding, examine what is said about polysemy, particularly in the psycholinguistics literature, and then show how what we seem to know about the representation and storage of polysemous senses affects the models that we have about lexical word meaning. In this paper we address the question of what determines the content of our conscious episodes of thinking, considering recent claims that phenomenal character individuates thought contents. We present one prominent way for defenders of phenomenal intentionality to develop that view and then examine ‘sensory inner speech views’, which provide an alternative way of accounting for thought-content determinacy. We argue that such views fare well with inner speech thinking but have problems accounting for unsymbolized thinking. Within this dialectic, we present (...) an account of the nature of unsymbolized thinking that accords with and can be seen as a continuation of the activity of inner speech, while offering a way of explaining thought-content determinacy in terms of linguistic structures and representations. The renewed interest in concepts and their role in psychological theorizing is partially motivated by Machery’s claim that concepts are so heterogeneous that they have no explanatory role. Against this, pluralism argues that there is multiplicity of different concepts for any given category, while hybridism argues that a concept is constituted by a rich common representation. This article aims to advance the understanding of the hybrid view of concepts. First, we examine the main arguments against hybrid concepts and conclude that, (...) even if not successful, they challenge hybridism to find a robust criterion for concept individuation and to show an explanatory advantage for hybrid concepts. Then we propose such a criterion of individuation, which we will call ‘functional stable coactivation’. The aim of this essay is to show that the subject-matter of ontology is richer than one might have thought. Our route will be indirect. We will argue that there are circumstances under which standard first-order regimentation is unacceptable, and that more appropriate varieties of regimentation lead to unexpected kinds of ontological commitment.

I propose a way of thinking aboout content, and a related way of thinking about ontological commitment. (This is part of a series of four closely related papers. The other three are ‘On Specifying Truth-Conditions’, ‘An Actualist’s Guide to Quantifying In’ and ‘An Account of Possibility’.).

Modal logicism is the view that a metaphysical possibility is just a non-absurd way for the world to be. I argue that modal logicists should see metaphysical possibility as "open ended'': any given possibilities can be used to characterize further possibilities. I then develop a formal framework for modal languages that is a good fit for the modal logicist and show that it delivers some attractive results.

The purpose of this paper is to defend a conception of language that does not rely on linguistic meanings, and use it to address the Sorites and Liar paradoxes.

According to an increasing number of authors, the best, if not the only, argument in favour of physicalism is the so-called 'overdetermination argument'. This argument, if sound, establishes that all the entities that enter into causal interactions with the physical world are physical. One key premise in the overdetermination argument is the principle of the causal closure of the physical world, said to be supported by contemporary physics. Whether or not we achieve absolute generality in philosophical inquiry, most philosophers would agree that ordinary inquiry is rarely, if ever, absolutely general. Even if the quantifiers involved in an ordinary assertion are not explicitly restricted, we generally take the assertion’s domain of discourse to be implicitly restricted by context.1 Suppose someone asserts (2) while waiting for a plane to take off.

We very often discover ourselves engaged in inner speech. It seems that this kind of silent, private, speech fulfils some role in our cognition, most probably related to conscious thinking. Yet, the study of inner speech has been neglected by philosophy and psychology alike for many years. However, things seem to have changed in the last two decades. Charles Travis has been forcefully arguing that meaning does not determine truth-conditions for more than two decades now. To this end, he has devised ingenious examples whereby different utterances of the same prima facie non-ambiguous and non-indexical expression type have different truth-conditions depending on the occasion on which they are delivered. However, Travis does not argue that meaning varies with circumstances; only that truth-conditions do. He assumes that meaning is a stable feature of both words and sentences. After surveying some (...) of the explanations that semanticists and pragmaticians have produced in order to account for Travis cases, I propose a view which differs substantially from all of them. I argue that the variability in the truth-conditions that an utterance type can have is due to meaning facts alone. To support my argument, I suggest that we think about the meanings of words (in particular, the meanings of nouns) as rich conceptual structures; so rich that the way in which a property concept applies to an object concept is not determined. Polysemy seems to be a relatively neglected phenomenon within philosophy of language as well as in many quarters in linguistic semantics. Not all variations in a word’s contribution to truth-conditional contents are to be thought as expressions of the phenomenon of polysemy, but it can be argued that many are. Polysemous terms are said to contribute senses or aspects to truth-conditional contents. In this paper, I will make use of the notion of aspect to argue that some apparently wild variations (...) in an utterance’s truth conditions are instead quite systematic. In particular, I will focus on Travis’ much debated green leaves case and explain it in terms of the polysemy of the noun; and in particular, in terms of the as-it-is and the as-it-looks aspects associated with kind words. Here is an account of logical consequence inspired by Bolzano and Tarski. Logical validity is a property of arguments. An argument is a pair of a set of interpreted sentences (the premises) and an interpreted sentence (the conclusion). Whether an argument is logically valid depends only on its logical form. The logical form of an argument is fixed by the syntax of its constituent sentences, the meanings of their logical constituents and the syntactic differences between their non-logical constituents, treated as (...) variables. A constituent of a sentence is logical just if it is formal in meaning, in the sense roughly that its application is invariant under permutations of individuals.1 Thus ‘=’ is a logical constant because no permutation maps two individuals to one or one to two; ‘∈’ is not a logical constant because some permutations interchange the null set and its singleton. Truth functions, the usual quantifiers and bound variables also count as logical constants. An argument is logically valid if and only if the conclusion is true under every assignment of semantic values to variables (including all non-logical expressions) under which all its premises are true. A sentence is logically true if and only if the argument with no premises of which it is the conclusion is logically valid, that is, if and only if the sentence is true under every assignment of semantic values to variables. Modal contingentists face a dilemma: there are two attractive principles of which they can only accept one. In this paper I show that the most natural way of resolving the dilemma leads to expressive limitations. I then develop an alternative resolution. In addition to overcoming the expressive limitations, the alternative picture allows for an attractive account of arithmetic and for a style of semantic theorizing that can be helpful to contingentists.

In Origins of Objectivity, Burge presents three arguments against what he calls ‘deflationism’: the project of explaining the representational function in terms of the notion of biological function. I evaluate these arguments and argue that they are not convincing.

The goal of this paper is to develop a theory of content for vague language. My proposal is based on the following three theses: (1) language-mastery is not rulebased— it involves a certain kind of decision-making; (2) a theory of content is to be thought of instrumentally—it is a tool for making sense of our linguistic practice; and (3) linguistic contents are only locally defined—they are only defined relative to suitably constrained sets of possibilities. This is an epistemologically-driven history of the concept of evolution. Starting from its inception, this work will follow the development of this pregnant concept. However, in contradistinction to previous attempts, the objective will not be the identification of the different meanings it adopted through history, but conversely, it will let the concept to be unfolded, to be explicated and to express its own inner potentialities. The underlying thesis of the present work is, therefore, that the path that leads to the (...) development of the concept of evolution is the path that studies the possibilities of the evolution of concepts, and that the historical reconstruction of its conceptual trajectory will shed light into potential and unexploited possibilities. This methodology will provide useful tools and resources for future developments of the concept. For example, it will define the concept of transmutation as a different conceptual trajectory deviating from the one corresponding to evolution, at the onset of the 19th century. Moreover, epigenesis will not be the opposing concept to evolution, but only to simultaneous and instantaneous generation. It will demonstrate that every important system of epigenesis drew upon some kind of formative power to explain development. More importantly, it will show that the problem of preformation cannot be overlooked, and that some kind of virtual preformation must be considered in order to address the problems of generation and development. This article deals with the relationship between language and thought, focusing on the question of whether language can be a vehicle of thought, as, for example, Peter Carruthers has claimed. We develop and examine a powerful argument—the "argument from explicitness"—against this cognitive role of language. The premises of the argument are just two: (1) the vehicle of thought has to be explicit, and (2) natural languages are not explicit. We explain what these simple premises mean and why we should believe (...) they are true. Finally, we argue that even though the argument from explicitness shows that natural language cannot be a vehicle of thought, there is a cognitive function for language. (shrink)

This paper is a reaction to the book “Science and the Pursuit of Wisdom”, whose central concern is the philosophy of Nicholas Maxwell. I distinguish and discuss three concerns in Maxwell’s philosophy. The first is his critique of standard empiricism (SE) in the philosophy of science, the second his defense of aim-oriented rationality (AOR), and the third his philosophy of mind. I point at some problematic aspects of Maxwell’s rebuttal of SE and of his philosophy of mind and argue in (...) favor of AOR. (shrink)

According to a model defended by some authors, dispositional concepts can be legitimately used in causal explanations, although such a use is not necessary. I argue, however, that there is a kind of use of dispositions in explanations that does not fall within this model: we will miss some explanations if we forsake dispositional concepts and explanations.

The topic of the relationship between the organism and its environment runs through the theories of Uexküll, Goldstein and Canguilhem with equal importance. In this work a counterpoint will be established between their theories, in the attempt to assess at which points the melodies are concordant and at which points they are discordant. As fundamental basis to his theory, Uexküll relies on the concept of conformity to a plan, which allows him to account for the congruity and perfect adjustment between (...) organisms and their Umwelten. For Goldstein and Canguilhem, the relationship between an organism and its environment resembles instead a debate or coming to terms, in which the organism, as to ensure the continuity of the state of health, must constantly create norms to maintain a productive relationship with its environment. The pinpointing of these conceptual frameworks allows to lay emphasis on that each theory relies on specific assumptions regarding teleology and sense in organisms, as well as on specific definitions of the concept of life in general. Ultimately, the view that organisms and their environments have an original and common source, a principle, or plan, which must possess all the creative characteristics of life, will be seen as prevailing. We can communicate linguistic information by asserting sentences that are not explicitly about linguistic matters. Stalnaker offers a pragmatic account of this phenomenon. It is not clear that such an account is correct. In this article I offer an alternative account that does not rely on pragmatic mechanisms and which captures many of the insights in Stalnaker's theory of linguistic communication. The view is inspired by Barker's semantics of vague adjectives.
